Welcome to Selections Souvenirs. These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and products (“Site”). By accessing or purchasing through this Site, you agree to be bound by these Terms. If you do not agree, kindly refrain from using this Site.
Selections Souvenirs reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Site after changes are posted implies your acceptance of those changes.
1. EXECUTION OF THE AGREEMENT

Please note:
Prices do not include shipping costs. These will be calculated and added at checkout.
Import duties, VAT, or taxes may apply depending on your country’s regulations. These are not included in our pricing and are the responsibility of the buyer upon delivery.
2. PRICING
Your submission of an order through our Site constitutes an offer to enter into a Purchase Agreement. Once you add an item to cart, select your preferred shipping and payment method, and complete the checkout process, you will receive an Order Confirmation via email detailing your purchase.
Please note:
The Order Confirmation does not signify acceptance of your order.
A binding Purchase Agreement is formed only when the product has been dispatched and you are notified via email or phone.
We reserve the right to request additional verification before accepting your order (e.g., phone number, physical address).
Selections Souvenirs reserves the right to cancel or reject any order at our discretion, including but not limited to:
Product availability
Payment authorization issues
Suspected fraud or illegal activity
3. PAYMENTS
Payments are considered complete only when received in full. Orders will not be processed without confirmed payment.
Accepted payment methods include:

Mobile Money (M-Pesa)
You will receive a payment link after checkout. All transactions are encrypted and processed via secure payment gateways.
4. SHIPPING & DELIVERY
We ship both locally within Kenya and internationally to over 30 countries.
Estimated delivery times:
Kenya: 1–3 business days
International: 7–14 business days (subject to customs and courier delays)
A tracking number will be provided once your order is dispatched. Please ensure your delivery address is correct. Selections Souvenirs is not liable for packages delayed or lost due to incorrect addresses or customs issues.
5. RETURNS & EXCHANGES
If you’re not fully satisfied with your purchase, you may return or exchange it within 14 days of delivery, provided that:
The item is unused
It is returned in its original packaging
Proof of purchase is provided

Return shipping costs are the responsibility of the buyer, unless the item received is defective or incorrect.
6. GIFT WRAPPING & CUSTOM NOTES
Yes — we offer gift wrapping and custom note options at checkout. Make your souvenir even more meaningful for birthdays, weddings, or holidays.
7. INTELLECTUAL PROPERTY
All content, photography, logos, designs, and handcrafted product descriptions on this Site are the property of Selections Souvenirs or our partnered artisans. Unauthorized reproduction or distribution is prohibited and may result in legal action.
8. INDEMNITY
You agree to indemnify, defend, and hold harmless Selections Souvenirs, its affiliates, directors, employees, and agents from any claims or demands, including legal fees, arising out of your violation of these Terms, applicable laws, or the rights of any third party.
9. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising hereunder shall fall under the exclusive jurisdiction of the courts of Kenya.

The Constitution of Kenya – the supreme law to which all other laws must conform.
The Kenya Information and Communications Act (KICA) – governing electronic communications, online transactions, and related matters.
10. ARBITRATION
Any disputes arising from the interpretation, implementation, or performance of these Terms shall be referred to arbitration in Nairobi under the rules of the Chartered Institute of Arbitrators (Kenya Branch). The arbitrator’s decision shall be final and binding.
We also reserve the right to seek injunctive relief in cases of unauthorized use of intellectual property or confidential information.
At Selections Souvenirs, we value clarity, fairness, and quick resolution of any concerns related to your online purchase. That’s why our Terms & Conditions provide for mediation or arbitration through the Chartered Institute of Arbitrators (Kenya Branch). This ensures that disputes—whether related to delivery, product condition, or payment—are handled by an impartial and professional body. While we always aim for amicable solutions through friendly mediation, arbitration provides a binding outcome when necessary.
11. LIMITATION OF LIABILITY
Selections Souvenirs shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Site or products. Our total liability shall not exceed the total amount paid by you for the product or service in question.
